Suspension of the Data Center Tax Credit Heads to Governor Kemp

On Thursday, March 14th, the Senate passed House Bill 1192 with a 29-22 vote. HB 1192 would suspend the issuance of any new sales and use tax certificates of exemption for data center projects in the state.
ACBR joined other members of the Data Center Coalition in opposition to this legislation because the abrupt suspension of the exemption brings into question the State's long-term commitment to its economic development program and policies, which threatens the certainty and predictability that is essential to financing large capital investments.
Furthermore, the bill undermines the competitiveness of Georgia in attracting and retaining businesses, as it sends a negative signal to companies looking to invest in the state.
It is unclear at this point if the Governor will sign the bill.
